So, we have this come up a lot where an individual passes away, and let’s say they reside primarily in Tennessee, but they also have properties elsewhere. You know, a lot of people have their Florida condo, and maybe their chalet that they go to as well in the mountains. And so, how do we administer those assets as well? So, generally probate is initiated in the county of the state where the individual resided at the time of their death. That’s where you would start first, and that will handle any personal

property and any real property that’s in with in that state. If there are real property outside of the estate, after the original probate is initiated, you might also have to initiate an ancillary probate administration in the state where the real property is located. And that’s initiated in the account where the real property is located in that state. Now, the one caveat I will say is as it relates to Tennessee, if you have property, let’s say here in Shelby County, but also property in Tipton

County, you wouldn’t have to do an ancillary probate in both counties. You would just do it in the county where the deceased resided at the time of their death, and then assuming there’s a will, record that probated will in the county where the real property is located. And so, there is a means to collect all of these assets. You just want to make sure that you’re checking with each state’s rules on how to do that when it comes to the ancillary administrations.
