Probate is a court supervised process of administering an individual’s assets after they pass. Probate is initiated in the county where the individual resided at the time of their death by filing a petition to open their estate and appoint a personal representative. The personal representative is known as an executive if the individual died with a will or known as an administrator if they died without a will. In Tennessee, the probate process is a minimum of four months if it’s initiated within one year of the individual’s date of death.
